Notice of Passing of a Zoning By‑law

 

New Village of Westport Comprehensive Zoning By-law No. 2026-27

TAKE NOTICE that the Council of the Corporation of the Village of Westport passed By‑law No. 2026-27 on the 15th day of September, 2026 under Section 34 of the Planning Act, R.S.O., 1990, Chapter P.13.

AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law may be made by filing a notice of appeal with the Clerk of the Village of Westport by mail or through the Ontario Land Tribunal e-file service (by selecting the ‘Village of Westport’ as the Approval Authority) no later than 4:30 p.m. on October 14th, 2026. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day.

AND TAKE NOTICE that the appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website. If the e-file portal is down, you can submit your appeal to the Village at: cao@villageofwestport.ca.

AND TAKE NOTICE that only the applicant, specified persons, public bodies, or the registered owner who made oral submissions at a public meeting or written submissions to Council, or the Minister may appeal a by-law to the Ontario Land Tribunal by filing a notice of appeal setting out the reasons for the appeal, accompanied by the fee required by the Ontario Land Tribunal.

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

THE SUBJECT LANDS are the entirety of the Village of Westport. Each property in the Village may be affected by the passage of the new Zoning By-law.

AN EXPLANATORY NOTE of the purpose and effect of the by‑law, and a description of the lands to which the by‑law applies, is provided below. Council considered all submissions in its decision on this matter.

Explanatory Note

Zoning By‑law No. 2026-27 is a new comprehensive zoning by-law under the Planning Act, R.S.O., 1990, Chapter P.13, Section 34, which has been adopted for the purpose of implementing the Village’s new Official Plan.   The Zoning By-law introduces various definitions, provisions and zones for the purpose of prohibiting and regulating the use of land and the erection, location and use of buildings and structures.

Zoning By-law No. 2026-27 applies to all lands within the corporate limits of the Village of Westport and repeals and replaces the existing comprehensive Zoning By-law No. 08-12 and all amendments thereto.

The effect of the adoption of Zoning By-law No. 2026-27 is to provide a new comprehensive zoning by-law to regulate land use in accordance with the policies of the Village’s new Official Plan.
