TAKE NOTICE THAT an application under the above file number will be heard by the Committee of Adjustment on the date, and at the time and place shown below, under the authority of Section 45 of the Planning Act. 

THE PURPOSE and EFFECT of the application is to seek relief from Comprehensive Zoning By-law No. 08-12, as amended, to permit the installation of two 3.05 m x 2.44 m shipping containers and one 6.1 m x 2.44 m shipping container to support pop-up retail uses.

The purpose of the minor variance application is to seek relief from Section 6.1.2.1.5 (C1 Zone Provisions) and Section 3.17.1.1 (Landscaped Open Space) of Zoning By-law 08-12, as amended, as follows:

2. To permit a reduced interior side yard setback of 2.4 metres, whereas the minimum interior side yard setback where the yard abuts a lot in a Residential Zone is 9 metres.
3. To permit a reduced continuous strip of landscaped open space of 2.4 metres, whereas a minimum of 3.0 metres is required.

The subject property is not the subject of any other applications under the Planning Act.
